Mr. Rosenthal founded The Rosenthal Law Firm, P.A., and concentrates his practice on all areas of commercial litigation, including creditor’s rights and bankruptcy, construction disputes, contract claims, real property disputes, and business dissolutions. Mr. Rosenthal has tried commercial cases in federal, state, and bankruptcy courts and has handled multiple arbitration proceedings.
Experience
In the creditor’s rights area, Mr. Rosenthal primarily represents financial institutions and other creditors in bankruptcy, state, and federal courts. His experience includes all areas of debt collection including replevin, foreclosure, executions, garnishments, enforcing preferred ship mortgages, and pursuing collateral and claims in bankruptcy court. Mr. Rosenthal has substantial experience defending creditors in bankruptcy adversary proceedings, such as preferential and fraudulent transfer actions, as well as defending against lender liability claims. Mr. Rosenthal also has unique and substantial experience defending creditors in bankruptcy adversary proceedings, such as preferential and fraudulent transfer actions, as well as defending against lender liability claims. Mr. Rosenthal also has unique and substantial experience with loan portfolios acquired from the Federal Deposit Insurance Corporation (“FDIC”). Mr. Rosenthal has worked with clients operating under loss-share agreements and has litigated special federal powers, including the D’Oench, Duhme doctrine.
Outside of litigation, Mr. Rosenthal represents creditors in the work-out of troubled loans, including the drafting and negotiation of forbearance agreements. Mr. Rosenthal’s debtor bankruptcy practice has included the representation of individual and corporate debtors.
Mr. Rosenthal’s construction dispute experience includes representing owners, contractors, and subcontractors in breach of contract claims, lien disputes, termination disputes, liquidated damages claims, claims for extra work/equitable adjustment, and negligent design claims. Mr. Rosenthal also litigates various commercial claims relating to real property, such as broker disputes, contract disputes, title disputes, and commercial landlord/tenant matters.
Education
Mr. Rosenthal is a 1994 honors graduate of the University of Florida College of Law. As a member of Florida Law Review, Mr. Rosenthal served as the Senior Notes and Comments Editor and published “Courts of Inequity: The Bankruptcy Laws’ Failure to Adequately Protect the Dalkon Shield Victims.” Mr. Rosenthal was also awarded the Gertrude Brick Law Review Apprentice Prize for Best Student Note. Mr. Rosenthal earned his Bachelor of Arts degree from the University of Florida in 1991.
Areas Of Practice
Mr. Rosenthal has extensive experience representing lenders in the area of admiralty law. His practice in this area includes the enforcement of both preferred ship mortgages and UCC security interests against federally documented vessels and state titled vessels.
Membership
Mr. Rosenthal is a member of the Florida Bar, Business Law Section, and is admitted to practice in the United States District Courts for the Northern, Middle, and Southern Districts of Florida. He is also a member of the American Bankruptcy Institute and the Orange County Bar Association. In 2010, Mr. Rosenthal was awarded an AV rating by Martindale-Hubbell. Mr. Rosenthal was also listed as one of Orlando’s Top Lawyers in Orlando Home & Leisure magazine in November 2010.
